Wann muss eine Nebentätigkeit angemeldet werden?

Grundsätzlich darf jeder Arbeitnehmer in Deutschland eine Nebentätigkeit ausüben — das Grundgesetz garantiert die Berufsfreiheit (Art. 12 GG). Allerdings gibt es wichtige Einschränkungen:

Vertragliche Anzeigepflicht

Die meisten Arbeitsverträge enthalten eine Klausel zur Nebentätigkeit. Typische Formulierungen:

  • "Nebentätigkeiten sind dem Arbeitgeber unverzüglich anzuzeigen."
  • "Nebentätigkeiten bedürfen der vorherigen schriftlichen Zustimmung."

Wichtig: Ein generelles Verbot von Nebentätigkeiten ist nach Rechtsprechung des BAG unwirksam. Ein Genehmigungsvorbehalt ist dagegen zulässig.

Gesetzliche Gründe für Anzeige

Auch ohne vertragliche Pflicht sollten Sie Ihre Nebentätigkeit anzeigen, wenn:

  • Sie im gleichen Bereich wie Ihr Hauptarbeitgeber tätig werden (Wettbewerbsverbot nach § 60 HGB)
  • Die Nebentätigkeit Ihre Arbeitskraft beim Hauptarbeitgeber beeinträchtigen könnte
  • Die Arbeitszeitgrenzen (ArbZG) überschritten werden könnten

Schritt-für-Schritt: Nebentätigkeit anmelden

Schritt 1: Arbeitsvertrag prüfen

Lesen Sie die Nebentätigkeitsklausel in Ihrem Arbeitsvertrag. Ist eine Anzeige oder Genehmigung erforderlich?

Schritt 2: Kollisionscheck durchführen

Prüfen Sie auf mögliche Konflikte:

  • Wettbewerb: Handelt es sich um einen Konkurrenten?
  • Arbeitszeit: Addiert sich die Gesamtarbeitszeit auf über 8h/Tag?
  • IP/Geheimhaltung: Gibt es Überschneidungen beim geistigen Eigentum?

Schritt 3: Schriftliche Anzeige verfassen

Informieren Sie Ihren Arbeitgeber schriftlich mit folgenden Angaben:

  • Art der Nebentätigkeit
  • Name des Zweitarbeitgebers (oder "Selbstständige Tätigkeit")
  • Voraussichtlicher Umfang (Stunden/Woche)
  • Geplanter Beginn

Schritt 4: Antwort abwarten

Ihr Arbeitgeber hat in der Regel 4 Wochen Zeit zu reagieren. Schweigt er, gilt die Nebentätigkeit als genehmigt (bei Genehmigungsvorbehalt).

Schritt 5: Dokumentation aufbewahren

Bewahren Sie den Schriftverkehr auf — bei späteren Streitigkeiten ist die Dokumentation Gold wert.

Wann darf der Arbeitgeber ablehnen?

Der Arbeitgeber darf die Nebentätigkeit nur ablehnen, wenn berechtigte Interessen verletzt werden:

  • Direkte Konkurrenztätigkeit
  • Überschreitung der ArbZG-Grenzen
  • Beeinträchtigung der Arbeitsleistung
  • Verstoß gegen Geheimhaltungspflichten

Eine pauschale Ablehnung ohne Begründung ist nicht zulässig.
